BYLAWS

DUTIESOFTHESCHOOLSITECOUNCIL

TheSchoolSiteCouncilofTierrasantaElementarySchool,hereinafterreferredtoasthecouncil,shallcarryoutthefollowingduties:

• Obtainrecommendationsfor,andreviewof,theproposedSinglePlanforStudentAchievement(SPSA)fromallschooladvisorycommittees.

• DevelopandapprovetheSPSAandrelatedcategoricalexpendituresinaccordancewithallstateandfederallawanddistrictregulations.

• RecommendtheSPSAandcategoricalexpenditurestotheSDUSDBoardofEducationforapproval.

• ProvideongoingreviewoftheimplementationoftheSPSAwiththeprincipal,teachers,andotherschoolstaffmembers.

• MakemodificationstotheSPSAwhenevertheneedarises.

• SubmitthemodifiedSPSAfordistrictapprovalwheneveramaterialchange(asdefinedindistrictgoverningboardpolicy)ismadeinplannedactivitiesorrelatedcategoricalexpenditures.

• Regularlyevaluatetheprogressmadetowardschoolgoalstoraisetheacademicachievementofallstudents.

• CarryoutallotherdutiesassignedtothecouncilbytheSDUSDBoardofEducationand bystatelaw.

MEMBERS

SECTION A:COMPOSITION*

Thecouncilshallbecomposedof 10membersasfollows:

• 3Classroomteachers

• 5Parents

• 1Other School Personnel (Classified or Certiicated)

• 1Principal

Theschoolprincipalshallbeanexofficiomemberofthecouncil.Theprincipalorhis/herdesigneeshallattendallcouncilmeetings;however,onlytheprincipalmayvoteonactions.Councilmemberschosentorepresentparentsmaybeemployeesoftheschooldistrictsolongastheyarenotemployedatthisschool.

SECTION B:TERMOFOFFICE

Councilmembersshallbeelectedfor2yearterms.Atthefirstregularmeetingofthecouncil,eachmember'scurrenttermofofficeshallberecordedintheminutesofthemeeting.

SECTION C: VOTINGRIGHTS

Eachmemberofthecouncilisentitledtoonevoteandmaycastthatvoteonanymattersubmittedtoavoteofthecouncil.Absenteeballotsshallnotbepermitted.Membersmayvotebye-mailusingtheprocedureforvotingbymailasdescribedinRobert'sRulesofOrder.

SECTION D:TERMINATION OF MEMBERSHIP

Thecouncilmay,byanaffirmativevoteoftwo-thirdsofallitsmembers,suspendorexpelamember.Anyelectedmembermayterminatehisorhermembershipbysubmittingawrittenletterofresignationtothecouncilchairperson.

SECTION E:TRANSFEROF MEMBERSHIP

Membershiponthecouncilmaynotbeassignedortransferred.

SECTION F:VACANCY

Anyvacancyonthecounciloccurringduringtheterm ofadulyelectedmembershallbefilledby:

• Ifvacancyoccursduringthecourseoftheschoolyear,appointmentbytwo-thirdsofthecouncil.

• Ifvacancyoccursbetweenschoolyears,regularelection.

ELECTIONS

Thecouncilshallholdregularelectionsforfillingvacantcouncilseatsatthefirstmeetingofthenewschoolyear.

Classroomteachersandclassifiedstaffmemberswillbenominatedforcandidacybytheirstakeholdergroups.Avoteoftwo-thirdsofthecouncilisrequiredforappointment.

Parentswillbenominatedforcandidacybysubmittinganapplicationform.Avoteoftwo-thirdsofthecouncil isrequiredforappointment.Priortothefirstcouncilmeetingofeachschoolyear,avarietyofmethodsmaybeusedtosolicitnominationsforparentmembers.

OFFICERS

SECTION A:OFFICERS

Theofficersofthecouncilshallbeachairperson,andsecretary.

Thechairpersonortheirdesigneeshall:

• Collaboratewiththeprincipalindevelopingagendasandreviewingminutespriortoposting.

• Presideatallmeetingsofthecouncil.

• Signallletters,reports,andothercommunicationsofthecouncil.

• Performalldutiesincidenttotheofficeofthechairperson.

• Haveothersuchdutiesasareprescribedbythecouncil.

Thesecretaryortheirdesigneeshall:

• Keepminutesofallregularandspecialmeetingsofthecouncil.

• Transmittrueandcorrectcopiesoftheminutesofsuchmeetingstomembersofthecouncil.

• Provideallnoticesinaccordancewiththesebylaws.

• Keeparegisterofthenames,addresses,andtelephonenumbersofeachmemberofthecouncil,thechairpersonsofschooladvisorycommittees,andotherswithwhomthecouncilhasregulardealings,asfurnishedbythosepersons.

• Performothersuchdutiesasareassignedbythechairpersonorthecouncil.

SECTION B:ELECTIONANDTERMSOFOFFICE

Theofficersshallbeelectedannually,atthefirstmeetingofthecouncil,andshallserveforoneyear,oruntilasuccessorhasbeenelected.

SECTION C:REMOVALOF OFFICERS

Anyofficermayberemovedfromofficebyatwo-thirdsvoteofallthemembers.

SECTION D:VACANCY

Avacancyinanyofficershallbefilledattheearliestopportunitybyaspecialelectionofthecouncilfortheremainingportionofthetermofoffice.

COMMITTEES

SECTION A:SUB-COMMITTEES

Thecouncilmayestablishandabolishsub-committeesoftheirownmembershiptoperformdutiesasshallbeprescribedbythecouncil.Atleastonememberrepresentingteachersandonememberrepresentingparentsshallmakeupthesub-committee.Nosub-committeemayexercisetheauthorityofthecouncil.

SECTION B:OTHERSTANDING AND SPECIAL COMMITTEES

Thecouncilmayestablishandabolishstandingorspecialcommitteeswithsuchcompositionandtoperformsuchdutiesasshallbeprescribedbythecouncil.Nosuchcommitteemayexercisetheauthorityofthecouncil.

SECTION C: COMMITTEETERMS OF OFFICE

Thecouncilshalldeterminethetermsofofficeformembersofacommittee.

SECTION D:RULES

Eachcommitteemayadoptrulesforitsowngovernmentnotinconsistentwiththesebylawsorrulesadoptedbythecouncil,orpoliciesofthedistrictgoverningboard.

SECTION E:QUORUM

Amajority(51%orgreater)ofthemembersofthecommitteeshallconstituteaquorum,unlessotherwisedeterminedbythecouncil.Theactofamajorityofthememberspresentshallbetheactofthecommittee,providedaquorumispresent.

MEETINGSOFTHECOUNCIL

SECTION A:MEETINGS

Thecouncilshallmeetregularly,typicallyonthelastMondayofeachmonth.Specialmeetingsofthecouncilmaybecalledbythechairperson.

SECTION B:PLACE OF MEETINGS

Thecouncilshallholditsregularmeetingsatafacilityprovidedbytheschool,unlesssuchfacilitythatisaccessibletothepublic,includinghandicappedpersons,isunavailable.Alternatemeetingplacesmaybedeterminedbythechairperson.

SECTION C:NOTICEOF MEETINGS

Writtenpublicnoticeofallmeetingsshallbegivenatleast72hoursinadvanceofthemeeting.Changesintheestablisheddate,time,orlocationshallbegivenspecialnotice.

Allregularlyscheduledmeetingsshallbepublicizedinthefollowingvenues:SchoolNewsletter,SchoolWebSite,andOutsideAnnouncementBoard.Specialmeetingsshallbepublishedonsamevenuesastimepermits.

Allrequirednoticesshallbedeliveredtocouncilandcommitteemembersnolessthan2businessdaysinadvanceofthemeeting,personallyorbye-mail.

SECTION D:QUORUM

Theactofthemajorityofthememberspresentshallbetheactofthecouncil,providedaquorum isinattendance,andnodecisionmayotherwisebeattributedto thecouncil.Amajorityofthemembersofthecouncil(51%orgreater)shallconstituteaquorum.Noactionsmaybetakenunlessaquorum hasbeenestablished.

SECTION E:CONDUCTOF MEETINGS

MeetingsofthecouncilshallbeconductedinaccordancewiththerulesoforderestablishedbyCaliforniaEducationCodeSection35147(c)andwithRobert'sRulesofOrderoranadaptationthereofapprovedbythecouncil.

SECTION F: MEETINGSOPEN TOTHE PUBLIC

Allmeetingsofthecouncil,andofcommitteesestablishedbythecouncil,shallbeopentothepublic.NoticeofsuchmeetingsshallbeprovidedinaccordancewithSectionCofthisarticle.

AMENDMENTS

Anamendmentofthesebylawsmaybemadeatanyregularmeetingofthecouncilbyavoteoftwo-thirdsofthememberspresent.Writtennoticeoftheproposedamendmentmustbesubmitted tocouncilmembersatleast2dayspriortothemeetingatwhichtheamendmentistobeconsideredforadoption.
